Digital Millennium Copyright Act (“DMCA”) Policy
Last Updated: Oct, 1st 2023
The DMCA Overview
The Digital Millennium Copyright Act (DMCA) provides a procedural framework for copyright owners to request ClientsWithAI to remove infringing content. Additional information about the DMCA can be located on the U.S. Copyright Office's official website.
It's crucial to note that all legal matters—including DMCA notices—can be intricate, and therefore, we highly recommend seeking professional advice for your unique situation. While this guide provides a general overview, it does NOT constitute legal counsel.
Ensure Accuracy in Your Information
Submitting a DMCA notice necessitates swearing to your submitted information under penalty of perjury, an action which carries substantial legal implications. Intentionally providing false information can lead to federal charges (see U.S. Code, Title 18, Section 1621) and potential civil liabilities.
Thorough Investigation is Key
In consideration of the extensive efforts put into content creation by millions of users and entities on ClientsWithAI, we urge you to carry out a comprehensive investigation and engage an attorney prior to sending a takedown request, ensuring that the use isn’t in fact allowed.
Initiating communication with the user directly might prove to be an invaluable first step before sending us a takedown request.
No Automated Submissions
Takedown notices should be considered and submitted by a trained professional to prevent erroneous actions. If a third party is handling your DMCA submissions, ensure that they are not utilizing automated bots to send notices en masse, as they can frequently be invalid and cause unnecessary content removal.
Counter-Notices
Affected users have the right to submit a counter-notice in response to your takedown notice. Should they do so, we will re-enable their content within 14 days unless we are notified that you have commenced legal action to prevent the user from engaging in the infringing activity relating to the content on ClientsWithAI.
The Determination Process
ClientsWithAI’s role in the process is limited to verifying whether the notices comply with DMCA’s minimum requirements. It's up to the involved parties and their legal representatives to assess the validity of their claims, keeping in mind that notices must be submitted under penalty of perjury.
